Understanding the GPSR
The General Product Safety Regulation (GPSR) is the European Union’s latest framework designed to strengthen consumer product safety rules. Fully enforced on 13 December 2024, it replaces the old GPSD and imposes stricter requirements on every business selling to EU consumers.
For online sellers—especially those outside the EU—non-compliance with GPSR can result in product bans, penalties, and removal from marketplaces like Amazon, eBay, and Shopify. In this guide, we break down the key GPSR obligations and how EAS can help you automate the process.
Why Is GPSR Important?
Unlike previous directives, the GPSR applies more rigorously to cross-border eCommerce. It introduces mandatory EU-based economic operators for non-EU sellers, increased liability for digital platforms, and stricter compliance documentation.
Key GPSR Obligations for Online Sellers
1. Appointment of an EU-Based Authorised Representative
Non-EU sellers must designate an Authorised Representative (AR) or Importer within the EU to take legal responsibility for product safety communication. Without one, products may be blocked at customs or removed from online platforms.
2. Product Safety and Traceability
GPSR requires that products follow EU safety standards, contain required details on labels/packaging, and include batch or serial numbers for traceability.
3. Marketplace and Digital Compliance
Platforms like Amazon, Etsy, and Shopify now require product safety information to be clearly visible on listings. Sellers must act within two working days to resolve safety issues or risk listing removal.
4. Incident Reporting
Sellers must notify EU authorities within two working days via the EU Safety Gate portal if a product presents a safety risk, and take immediate corrective actions like recalls.
5. Documentation Retention
Detailed safety documentation and instructions must be kept for up to 10 years. Failure to present these during an audit can lead to significant fines.
