GPSR compliance EU
A Guide for eCommerce Sellers
What Is GPSR Compliance in the EU?
The General Product Safety Regulation (GPSR) is the European Union’s latest framework ensuring that all consumer products sold in the EU meet stringent safety requirements. Effective from December 13, 2024, GPSR replaces the previous General Product Safety Directive (GPSD) and introduces stricter obligations for businesses selling online and cross-border.
For eCommerce merchants—especially those outside the EU—ensuring GPSR compliance is critical to avoid penalties, product recalls, and legal risks. This guide breaks down the essentials of GPSR compliance for businesses selling into the EU.
Why Is GPSR Important for eCommerce?
1. Expanded Liability for Online Sellers and Marketplaces
Under GPSR, online marketplaces and cross-border sellers bear greater responsibility for ensuring the safety of products. If a non-EU seller lacks an Authorised Representative (AR) or an Importer, platforms like Amazon and Shopify may block listings or remove non-compliant products.
2. New Documentation and Traceability Requirements
Businesses must maintain up-to-date technical documentation proving that their products meet EU safety standards. This includes:
• A Declaration of Conformity, or Certificate of Conformity for CE-marked products
• Technical Document (not as scary as it may sound)
3. Mandatory EU-Based Economic Operator / Authorised Representative
Every product sold in the EU must have an EU-based economic operator (e.g., authorised representative, EU-Based manufacturer) being the first point of contact for the EU Market Surveillance Authorities. Without this, products cannot be legally sold in the EU.
4. New Product Safety and Reporting Obligations
Merchants must comply with stricter:
• Labelling requirements (with contact details of the responsible EU entity).
• Incident reporting within two working days if a product poses safety risks.
Who Needs to Comply With GPSR?
GPSR applies to all non-food, non-cosmetic consumer products, as well as products that could potentially be used by consumers, sold within the EU, including but not limited to:
✅ Books and Magazines
✅ Fashion and textiles
✅ Electronics and accessories
✅ Toys and children’s products
✅ Home goods and furniture
✅ Beauty and personal care items
✅ 3D-printed accessories
✅ Fitness and sports equipment
If you sell any of these products to EU consumers, you must comply, also if you ship from outside the EU.
Steps to Achieve GPSR Compliance
1. Identify Your Economic Operator / appoint your Authorised Representative
If you’re a non-EU seller, you must appoint an Authorised Representative (AR) or work with an EU-based Importer to fulfil GPSR requirements.
2. Ensure Your Product Documentation Is Ready
Prepare and maintain:
• Technical files detailing product specifications and Safety assessments
• Compliance declarations
3. Label Products Correctly
All products must display:
• The name and address of the Authorised Representative
• Batch or serial numbers for traceability (recommeneded)
• Clear safety instructions (if applicable)
4. Set Up a Compliance Monitoring System
Regularly audit suppliers, update safety documentation, and stay informed on evolving EU product safety regulations.
