GPSR Compliance EU

Your comprehensive guide to navigating the General Product Safety Regulation. Ensure seamless EU market access and avoid marketplace bans for your eCommerce store.

What Is GPSR Compliance in the EU?

The General Product Safety Regulation (GPSR) is the European Union’s latest framework ensuring that all consumer products sold in the EU meet stringent safety requirements. Effective from December 13, 2024, GPSR replaces the previous GPSD and introduces stricter obligations for businesses selling online and cross-border.

For eCommerce merchants—especially those outside the EU—ensuring GPSR compliance is critical to avoid penalties, product recalls, and legal risks. This guide breaks down the essentials for businesses selling into the EU market.

Why Is GPSR Important for eCommerce?

1. Expanded Liability for Online Sellers

Under GPSR, online marketplaces and cross-border sellers bear greater responsibility. If a non-EU seller lacks an Authorised Representative (AR) or an Importer, platforms like Amazon and Shopify may block listings or remove non-compliant products.

2. New Documentation and Traceability Requirements

Businesses must maintain technical documentation proving that their products meet EU safety standards. This includes Declarations of Conformity and technical documents detailing safety assessments.

3. Mandatory EU-Based Economic Operator

Every product sold in the EU must have an EU-based economic operator (e.g., authorised representative, importer) to act as the primary contact for Market Surveillance Authorities. Without this, products cannot be legally sold in the EU.

4. Stricter Labelling and Reporting

Merchants must adhere to strict labelling requirements and notify authorities within two working days if a product poses a safety risk.

Who Needs to Comply?

GPSR applies to all non-food, non-cosmetic consumer products sold within the EU, including:

Fashion & Textiles
Electronics
Toys & Children’s Goods
Home & Furniture
Fitness Equipment
3D-Printed Goods

If you sell any of these products to EU consumers, you must comply, even if you ship from outside the EU.

Steps to Achieve Compliance

  1. Identify Your Economic Operator: Non-EU sellers must appoint an Authorised Representative (AR).
  2. Prepare Product Documentation: Maintain technical files, safety assessments, and compliance declarations.
  3. Label Correctly: Products must display the AR’s contact details, batch/serial numbers, and safety instructions.
  4. Setup Monitoring: Regularly audit suppliers and stay informed on safety regulations.
  5. Automate: Use EAS GPSR services to simplify the regulatory process.
